Illinois Sexual Assault And Statutory Rape Laws

In Illinois, sexual assault is any nonconsensual sexual act, including those involving minors or individuals incapable of consent. Criminal sexual assault, or rape, involves sexual penetration with:

  • Force
  • A victim unable to consent
  • A family member under 18
  • An accused 17 or older in authority over a victim aged 13-18

Penalties are severe, with the following breakdown:

  • First offense: Class 1 felony, four to 15 years in prison
  • Subsequent offenses: Class X felony, six to 30 years
  • Aggravated cases: Class X felony, six to 60 years

Statutory rape, also called “criminal sexual abuse,” involves any sexual activity with someone under 17, the age of consent in Illinois. This includes kissing, fondling, oral sex and penetration. Charges can apply even if both parties are minors. Illinois considers age differences and may offer reduced penalties in some cases but lacks a full “Romeo and Juliet” exemption. If you’re facing rape accusations, it’s crucial to seek lawyers with extensive experience in sex crimes and criminal defense to protect your rights and future.

Aggravated Criminal Sexual Abuse

Aggravated criminal sexual abuse is another serious sex crime in Illinois, distinct from criminal sexual assault (rape). While rape specifically involves penetration, aggravated criminal sexual abuse encompasses a broader range of sexual conduct, including touching or molestation. This offense often involves situations where there’s an abuse of trust or authority or significant age differences, even if there’s no force involved.

The law defines aggravated criminal sexual abuse as engaging in sexual conduct under these circumstances:

  • With a family member under 18
  • When the defendant is 17 or older and the minor is under 13
  • When the defendant is at least 17, in a position of authority and the minor is 13-18
  • When the defendant is under 17 and the minor is under nine
  • When there’s at least a five-year age gap, with the minor being 13-17

Aggravated criminal sexual abuse is charged as a Class 2 felony, carrying severe penalties:

  • A fine ranging from $25 to $25,000
  • Three to seven years in prison

While aggravated criminal sexual abuse is a serious offense, there’s an even more severe charge called aggravated criminal sexual assault, which typically involves sexual penetration. Both charges carry significant penalties.

Sex Crimes Charges: Addressing Common Concerns

Will I have to register as a sex offender?

One of the most damaging penalties someone can receive after a conviction is having to register as a sex offender. The sex offender registry is an online database that contains your name, age, distinguishing characteristics and details about the crime.

If convicted of a sex crime in Illinois, such as offenses related to child pornography or meeting a minor for unlawful purposes, you may have to register as a sex offender. Registration lasts 10 years to a lifetime, so this can have a huge impact on finding a place to work and live.
